What’s a ZBA Hearing?

We’ve applied to Adams’ Zoning Board of Appeals (ZBA) for a special permit and three variances. We need all of those approved before we can move in and start operations at 9 Grove St. Because zoning is confusing, here’s a breakdown of what all that means:

Special Permit:

Our business is considered a kennel or animal hospital by Adams Zoning bylaws. That means, we’re allowed to operate in the designated zones with permission from the ZBA. (Here’s the table)

The designated zones include: business (B1, B2), industrial (I), and rural residential (R1). That’s not all, there are more stipulations we must meet:

  • The property must be at least 2 acres

  • Buildings must be more than 150 feet from lot lines

  • Buildings must be more than 150 from the street

It’s all pretty strict, especially considering we don’t keep animals overnight or treat them medically like a kennel or animal hospital might. However, the ZBA can decide to grant an exception (i.e. a “variance”) for regulations relating to distances and fencing.

Variances:

We’re applying for three total:

  1. To let us operate in a lot that is less than 2 acres This lot is .23 acres (See photo)

  2. To grant us an exception for the buildings being less than 150 feet from lot lines and the street. From the neighboring lot, the building is 14’ on the north, 20’ on the east, 20’ on the west, and 27’ from the street to the south. (See photo)

  3. To allow a 6’ fence (chain link or similarly transparent) less than 20 feet from the street (see Adams Fence regulations)

How you can help:

  1. Show up to the ZBA hearing on January 14th at 6PM.
    The meeting will be at the Adams Town Hall, 8 Park St, in the Mahogany Room. If you park in the back and walk in the back door, it’ll be on the left.

  2. Send a letter of support on our behalf to the Zoning Board. If you can’t make it to the hearing, you can send an email to kbelanger@town.adams.ma.us or a letter to:
